The LL88 Covered Buildings List: Is Your Building On It?

What DOB's list is, why smaller buildings appear on it, and a 10-second way to check yours.

What the List Is, and Who Ends Up On It

The DOB Sustainability Law Covered Buildings List is the city's record of which buildings owe filings under its building energy laws, LL88 included. It's republished every March as a spreadsheet on the DOB LL88 page. Per DOB, only buildings that have not yet demonstrated compliance are required to file in the current year, and a building already in compliance may still appear on the list.

The base rule is a building over 25,000 gross square feet. Smaller buildings get pulled in two ways:

  • Same tax lot. Buildings sharing a tax lot that together exceed 100,000 gross square feet are each covered.
  • Same condo board. Condominium buildings under one board of managers that together exceed 100,000 gross square feet are covered.

My building is on the list but we already did the work. Now what?
Being on the list doesn't by itself mean more work is owed; DOB says a compliant building may still appear. What matters is whether the compliance report was filed. If the work is done and the report isn't on record, the filing is what resolves it.
My building is under 25,000 sq ft. Can it still be covered?
Yes, through aggregation. Per DOB, buildings sharing a tax lot that together exceed 100,000 gross square feet are covered, and so are condominium buildings under one board of managers that together exceed 100,000 gross square feet. A 20,000 sq ft building can be covered because of its neighbors.
Are landmarked buildings exempt?
No. DOB's FAQ says landmarked buildings must comply if they meet the covered-building definition. The listed exceptions are one-to-three-family homes and garden-style apartments, plus space-level carve-outs such as R-2 and R-3 dwelling units.
Where does DOB publish the list?
On the DOB LL88 page, linked in the sources below. It's a spreadsheet republished every March, with a column indicating each building's LL88 status. The prior year's list stays up for reference, and DOB notes it may be outdated.
